There is no doubt that Donald Trump is guilty of many, many serious crimes. Perhaps the most serious is his open attempt to overthrow the government on January 6th.
For this alone, under the Constitution he is disqualified from every holding any office in government by the words of the 14th amendment:
"No person shall be a Senator or Representative in Congress, or elector of President and Vice President, or hold any office, civil or military, under the United States, or under any state, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any state legislature, or as an executive or judicial officer of any state, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability."
But nobody has upheld this law with respect to Donald Trump, nor with respect to any of the insurrectionists (or those who have given aid or comfort to those insurrectionists). In other words, the law has been broken many times, the Constitution violated many times, and NOTHING MEANINGFUL HAS BEEN DONE.
Remember, that every single elected Federal official has worn to uphold the Constitution and is obligated to prevent any insurrectionist from holding office. This goes doubly for the SCOTUS who job IS to ensure that the Constitution is properly understood and honored.
And the actual JOB DESCRIPTION of the President of the United States is to ensure that the laws are faithfully executed.
As of now, the entire government—both parties—have failed to do their jobs and are openly violating their oaths of office. IF they were doing their jobs, every single officeholder who participated or even simply gave aid or comfort to insurrectionists would be thrown out of office and prosecuted to the fullest extent of the law.
It's a hopeful sign that some states are prosecuting Donald Trump, but it's been very slow and whatever these states accomplish, this doesn't change the fact that all three branches of government have failed dismally and continue to do so.
